Welcome to Hamease, a product of Hamhey GmbH. By accessing or using our services, you agree to be bound by these Terms of Service.
1. Services
Hamease provides property management software services designed for landlords, including tenant management, rent collection tracking, maintenance request handling, and related features. Our services are provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of our services at any time.
2. Nature of Service - Software Platform
Hamease is a software-as-a-service (SaaS) platform that provides property management tools to landlords and property owners. Hamease does not provide property management, real estate brokerage, or tenant placement services. You (the Customer) remain the legal property manager and are solely responsible for: all property management decisions and actions; tenant screening, selection, and contracting; legal compliance with tenancy laws and regulations; maintenance and repairs; rent collection and enforcement; and all communications with tenants. Hamease provides software tools that enable you to perform these tasks more efficiently. Any automated messages, reminders, or workflows are sent on your behalf using your account, but all legal responsibility remains with you. Technical support and onboarding services provided by Hamease are limited to software configuration, training, and technical implementation. They do not constitute property management services.
3. Account Registration
To use Hamease, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. User Responsibilities
You agree to use Hamease only for lawful purposes and in accordance with these Terms. You shall not:
- Use the service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the service
- Upload malicious code or harmful content
- Violate any applicable laws or regulations
5. Fees and Payment
Certain features of Hamease require payment of fees. All fees are quoted in Euros and are non-refundable unless otherwise specified. We reserve the right to change our pricing at any time, with reasonable notice to existing customers.
6. Data and Privacy
Your use of Hamease is also governed by our Privacy Policy. You retain ownership of all data you upload to Hamease. By using our services, you grant us a limited license to process your data as necessary to provide the services.
7. Intellectual Property
Hamease and its original content, features, and functionality are owned by Hamhey GmbH and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of our service without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Hamhey GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
9. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the service after such changes constitutes acceptance of the new Terms.
